Police Identify Suspect in 1991 ‘Yogurt Shop Murders’ Case Just 2 Months After HBO Docuseries Debut https://www.thewrap.com/yogurt-shop-murders-police-identify-suspect-brashers-1991-hbo-docuseries/ Sun, 28 Sep 2025 17:18:10 +0000 https://www.thewrap.com/?p=7853200 Investigators in Austin, Texas, say they've made a "significant breakthrough" in the case that traumatized the city for decades

]]>
Police in Austin, Texas, say they have made a “significant breakthrough” using DNA and ballistics evidence that identifies a suspect in the infamous killing of four teens in 1991, just two months after HBO premiered its docuseries “The Yogurt Shop Murders.”

The victims, who ranged in age from 13 to 17, had met at an I Can’t Believe It’s Not Yogurt! shop on a busy street where two of them were employees. They were bound, gagged and at least two were sexually assaulted before the shop was set on fire.

City investigators on Friday said their suspect was Robert Eugene Brashers, who shot himself in a 1999 standoff with police. The breakthrough was first reported by The Austin American-Statesman.

“Austin Police have made a significant breakthrough,” authorities announced on the city’s website. “For almost 34 years they have worked tirelessly and remained committed to solving this case for the families … We have identified a suspect in these murders through a wide range of DNA testing.”

Two 17-year-olds, Eliza Thomas and Jennifer Harbison, were working at the store on Dec. 6, 1991. Harbison’s 15-year-old sister Sarah and friend Amy Ayers, 13, came to meet them at the end of their closing shift.

Firefighters responded to a midnight fire at the store, battling the blaze until morning, when the bodies were discovered. Each had been bound in their own clothes and shot in the head; evidence showed someone had poured an accelerant on their bodies and set them on fire.

Brashers had never before been a suspect. Police at first believed there were multiple assailants, and four men – teens at the time of the murders – were arrested in 1999. Two of them were later convicted, but their guilty verdicts were overturned by an appeals court.

Prosecutors used new DNA testing technology in 2007 in preparation for a new trial, but the results did not match the suspects, and the investigation had once again gone cold.

Years later, that DNA testing led investigators to three other murders – and Brasher, after police ran the genetic profile through an online genealogy database. A bullet casing found at the yogurt shop matched the weapon Brashers used to shoot himself, CBS News reported Friday, citing a retired Austin police officer.

The breakthrough ends decades of aftermath from the murders, which haunted families and residents who commemorated them through the years.

The four-episode HBO docuseries “The Yogurt Shop Murders,” which premiered Aug. 3 – before Brashers’ identity had been discovered – included interviews with family members and friends who took part in the project that focused mainly on processing memory and grief.

The series, executive produced by Emma Stone and Dave McCary under their Fruit Tree banner, was not a factor in the identification of Brasher. It was produced by A24, which supplied therapy to the production team due to the graphic nature of the case.

Trump Would-Be Assassin Ryan Routh Convicted in Florida, Faces Life in Prison https://www.thewrap.com/trump-assassin-attempt-ryan-routh-convicted-life-in-prison/ Tue, 23 Sep 2025 19:09:18 +0000 https://www.thewrap.com/?p=7849323 Routh, who represented himself at trial, was convicted Tuesday of attempting to assassinate a presidential candidate

Ryan Routh, the North Carolina man who was caught staking out Donald Trump at his Florida golf course with a semi-automatic rifle last year, was convicted Tuesday of attempting to assassinate a presidential candidate, a charge that could send him to prison for life.

A federal jury in Fort Pierce, Florida, found Routh, 59, guilty of the assassination attempt along with assaulting a federal officer and multiple firearm violations. Prosecutors said Routh, a drifter and construction worker, hid in the shrubbery near Trump International Golf Club in West Palm Beach on Sept. 15, 2024, pointing a rifle with its serial number filed off at a Secret Service agent before fleeing. He was arrested less than an hour later on Interstate 95.

“This defendant was one bullet away,” Assistant U.S. Attorney Christopher Browne told jurors in closing arguments, the New York Times reported Tuesday.

The trial lasted just 12 days. It was unusual both for its speed and because Routh represented himself; Judge Aileen Cannon, who previously oversaw the federal case against Trump over classified documents, repeatedly cut off his unfocused arguments.

Routh called only three witnesses, while prosecutors presented extensive testimony from law enforcement officers and forensic experts.

Investigators said Routh lived out of an SUV for weeks while surveilling Trump’s movements, researching campaign events and watching his plane at Palm Beach International Airport. Evidence included cellphones, license plates, surveillance videos and a letter in which Routh wrote, “This was an assassination attempt on Donald Trump but I failed you,” offering a $150,000 bounty for the killing.

The verdict followed a year marked by multiple threats of political violence and the Sept. 10 assassination of conservative activist Charlie Kirk. It was the second attempt on Trump’s life in 2024, during his campaign to return to the White House.

Routh, who told jurors prosecutors had not proven “any intent,” faces sentencing later this year.

Sacramento police have arrested Anibal Hernandez-Santana, 64, in connection to a drive-by shooting at an ABC affiliate in the city.

Hernandez-Santanta was taken into custody Saturday morning and charged with assault with a deadly weapon, negligent discharge of a firearm and shooting into an occupied building.

“Thanks to the prompt and diligent work of our responding officers and investigators, the suspect vehicle was identified, leading officers to a residence in the 5400 block of Carlson Drive,” the Sacramento Police Department said in a statement shared on social media.

“The motive remains under investigation, and we would like to thank the FBI for providing resources in support of this investigation,” the department added.

Multiple news reports indicate Hernandez-Santanta is currently being held on $200,000 bail. The Sacramento Police Department did not immediately reply to TheWrap’s request for commment.

Hernandez-Santana is accused of firing shots at the station’s headquarters around 1:30 p.m. Friday. Though the building was occupied, no one was hurt.

Sacramento news station KCR3 shared a statement from Tegna, the parent company of ABC10: “We can confirm that shots were fired into our station at KXTV earlier today. While details are still limited, importantly all of our employees are safe and unharmed. We are fully cooperating with law enforcement and have taken additional measures to ensure the continued safety of our employees.”

The office of California Gov. Gavin Newsom also issued a statement on social media: “The Governor has been briefed on reports of a shooting at a local ABC affiliate in Sacramento. While no injuries have been reported, any act of violence toward journalists is an attack on our democracy itself and must be condemned in the strongest terms. We stand with reporters and staff who work every day to keep communities informed and safe!”

An ABC10 news broadcast building in Sacramento was struck by gunfire Friday, one day after a protest against the suspension of Jimmy Kimmel was held outside the Tegna-owned affiliate.

Police were called to the scene off Broadway around 1:30 p.m. Pacific Friday. At least three rounds were shot into the building’s front window. No injuries were reported, but the building was occupied at the time, according to local media. There is no suspect or motive at this time.

“We can confirm that shots were fired into our station at KXTV earlier today. While details are still limited, importantly, all of our employees are safe and unharmed,” representatives for Tegna said in a statement to press. “We are fully cooperating with law enforcement and have taken additional measures to ensure the continued safety of our employees.”

The incident occurred one day after a protest was held at the Sacramento site — one of many held nationwide over ABC pulling “Jimmy Kimmel Live!” from the air following pressure from the FCC and media groups Nexstar and Sinclair to punish its host for comments made Monday about the Charlie Kirk assassination.

“People cannot collaborate with fascism, and that’s exactly what ABC and Disney was doing,” Chantelle Piper, an organizer with the Revcom Corps for the Emancipation of Humanity in Los Angeles, told TheWrap at a Wednesday protest outside Disney’s Burbank headquarters. “They’re collaborating with fascism and they’re bending the knee and that cannot be allowed,” Piper said. “It’s important that the industry came out and said, ‘We do not agree with this, we do not support this and we condemn that Kimmel was taken off the air.’”

Tegna, which owns the Sacramento affiliate subject to Friday’s shooting, is currently in talks for a $6.2 billion merger with Nexstar. Such a consolidation is subject to FCC chair Brendan Carr’s approval and brings the pressure campaign from the President Donald Trump appointee and Nexstar under greater scrutiny.

It is unclear whether the gunfire Friday was related to the Kimmel protests. TheWrap will update this story with any developments.

Bret Baier is baffled by people who still believe Charlie Kirk’s killer was MAGA.

While talking to Fox News’ Brian Kilmeade on his radio show, Baier expressed frustration by people still confused on Tyler Robinson’s motive behind his assassination of Kirk last week. The “Special Report” host said the motive was clear as day.

“I’ve seen that’s where it’s like, ‘We don’t have a motive.'” Baier said. “Well, what was that reading of the probable cause in the indictment? It was all motives. It was hatred for him – his beliefs that Charlie Kirk is spreading hate. He felt that this was the time. He planned it for a week. In his own words, that is the motive. I mean, it’s right there.”

He continued: “The other thing is that even today, after all of that, there are still outlets that are saying: ‘This kid is from a MAGA family,’ and he was really a conservative who grew up in a gun culture and that’s the problem. It’s baffling.”

Robinson was formally charged with Kirk’s murder on Tuesday. He was charged with seven counts including aggravated murder, felony discharge of a firearm, two counts of obstruction of justice and two counts of witness tampering. The seventh count was the commission of a violent offense in the presence of a child.

Utah state attorney Jeff Gray announced in the press conference that he intends to seek the death penalty. Gray explained that a statement from Robinson’s mother found that her son and his roommate, a trans woman, were romantically involved and that the accused shooter had grown increasingly liberal over the last year with an emphasis on trans and LGBTQ+ rights.

“Robinson’s mother explained that over the last year or so, Robinson had become more political and had started to lean more to the left, becoming more pro-gay and -trans rights oriented,” Gray said. “She stated that Robinson began to date his roommate, a biological male who was transitioning genders. This resulted in several discussions with family members, but especially between Robinson and his father, who have very different political views. In one conversation before the shooting, Robinson mentioned that Charlie Kirk would be holding an event at UVU, which Robinson said was a stupid venue for the event. Robinson accused Kirk of spreading hate.”

ABC reporter Matt Gutman has apologized for calling the text messages between alleged Charlie Kirk shooter Tyler Robinson and his partner “very touching.”

“Yesterday I tried to underscore the jarring contrast between this cold-blooded assassination of Charlie Kirk — a man who dedicated his life to public dialogue — and the personal, disturbing texts read aloud by the Utah County Attorney at the press conference,” Gutman said in an Instagram post on Wednesday. “I deeply regret that my words did not make that clear.”

Gutman’s apology all comes as a response to the reporter’s reaction to Robinson’s text conversations, which were unveiled during the announcement of Robinson’s murder charges.

“But, also, it was very touching in a way that many of us didn’t expect,” Gutman said at the time. “A very intimate portrait into this relationship between the suspect’s roommate and the suspect himself, with him repeatedly calling his roommate, who is transitioning, calling him ‘my love.’ And ‘I want to protect you, my love.'”

He added: “So, it was this duality of someone who the attorney said not only jeopardized the life of Charlie Kirk and the crowd, but was doing it in front of children, which is one of the aggravating circumstances of this case. And then, on the other hand, he was, you know, speaking so lovingly about his partner. So a very interesting and … riveting press conference.”

Despite his initial thoughts on the matter, Gutman assured his followers that he condemns Robinson’s actions.

“But let there be zero doubt here: I unequivocally condemn this horrific crime and the pain it caused Charlie Kirk’s family, those who were forced to witness it at UVU, and the millions of people he inspired,” he said, concluding his message.

Kirk was fatally shot during a public speaking appearance at Utah Valley University on Wednesday. His suspected shooter has been identified as 22-year-old Tyler Robinson. Robinson was charged with aggravated murder, felony discharge of a firearm causing serious bodily harm, obstruction of justice, two counts of witness tampering and commission of a violent offense in the presence of a child.

Ryan ruled Monday that “the evidence alleged here is not so compelling that it would have produced a reasonable doubt in the mind of at least one juror,” the DA says

Following a Los Angeles Superior Court judge’s tossing of Erik and Lyle Menendez’s bid for a retrial Monday, L.A. DA Nathan Hochman touted in a press conference that “we got it right.”

Hochman held a press conference Tuesday to cover the earlier announcement that the Menendez brothers’ efforts for a retrial had been thwarted. The L.A. DA thanked the tireless efforts of the prosecutors for the work they put in ahead of Monday’s decision.

“Let me thank the prosecutors who spent an enormous amount of time effort research to make sure that we got it right,” Hochman said. “And that was the goal. Let’s put in the hard work to make sure we get all the facts in front of the judge, so that the judge can then make a decision based on the entire record, not just some parts of the record, as certain Netflix documentaries, certain parts of the social media has picked on.”

The ruling to deny the brothers’ petition for a new trial came from Los Angeles Superior Court Judge William C. Ryan on Monday morning.

“The court finds that these two pieces of evidence presented here would not have resulted in a hung jury, nor in the conviction of a lesser instructed offense,” Ryan said.

He continued: “Neither piece of newly discover [sic] evidence is particularly strong. The evidence alleged here is not so compelling that it would have produced a reasonable doubt in the mind of at least one juror or supportive of an imperfect self-defense instruction.”

The brothers became eligible for parole in May 2025 when a judge reduced their sentences to 50 years to life. By August, both Lyle and Erik were separately denied their request for parole by a California Parole Board panel 24 hours apart. Their retrial efforts have now been similarly dismissed.

The Menendez brothers were sentenced to life in prison in 1996 after killing their father Jose and mother Kitty in Aug. 1989. Defense attorneys at the time argued that the brothers acted in self-defense following years of sexual abuse from their father.

“When we looked at both the resentencing issue and ultimately the parole issue, we determined that the Menendez brothers had never come fully clean with the central defense that they had, that they had articulated during trial – the self-defense effects,” Hochman added in the press conference.

The Menendez Brothers’ next parole hearing is in three years.

Tyler Robinson was formally charged Tuesday in the Sept. 10 assassination of Charlie Kirk with a total of seven counts, including aggravated murder.

The alleged shooter was also charged with the felony discharge of a firearm, two counts of obstruction of justice and two counts of witness tampering. The seventh count was the commission of a violent offense in the presence of a child.

Utah state attorney Jeff Gray announced in Tuesday’s press conference that he intends to seek the death penalty for the 22-year-old.

“I do not take this decision lightly,” he said. “And it is a decision I have made independently as county attorney based solely on the available evidence and circumstances and nature of the crime. Because we are seeking the death penalty, the defendant will continue to be held without bail in the Utah County Jail.”

Watch the live press conference below:

The first two counts of aggravated murder and felony discharge of a firearm causing serious bodily injury were further alleged with aggravating factors because Robinson apparently targeted Kirk, a prominent conservative youth organizer and activist, for his political beliefs and expression.

The first count of obstruction of justice was for Robinson’s alleged moving and concealing of the rifle used in the shooting; the second was for disposing of the clothing he wore. The first count of witness tampering was for telling his roommate to delete all incriminating texts; the second was for telling his roommate to stay silent and not speak to police or media.

Detailing provided statements from Robinson’s mother, Gray expanded on the state’s findings that her son and his roommate, a trans woman, were romantically involved and that the accused shooter had grown increasingly liberal over the last year with an emphasis on trans and LGBTQ+ rights.

Gray also laid out the events of Sept. 10, from Robinson’s arrival on the Utah Valley University campus — where Kirk was launching his “The American Comeback Tour” — to his fleeing the scene from a campus building’s rooftop to his parents’ involvement in recognizing their son as the prime suspect and persuading him to turn himself in. Robinson’s parents alleged that their son weighed killing himself and did not want to go to jail, Gray said, adding that he “explained there is too much evil in the guy,” referring to Kirk.

Robinson’s roommate also detailed to authorities how she came to realize that he was involved in Kirk’s assassination, Gray said. The roommate told police that she found a note under Robinson’s computer that read, “I have the opportunity to take out Charlie Kirk, and I’m going to take it.” Gray also read through text messages between Robinson and the roommate, where he confessed to killing Kirk, professed his love for her (“You are all I worry about love”) and also insisted “Don’t talk to the media,” and if police questioned her, “ask for a lawyer and stay silent.”

Alleged texts between Robinson and his roommate also covered the previously reported etchings on his bullet casings, many of which nodded to gaming memes and other niche, online culture.

“I understand the public’s desire to know the facts. My own family members have pressed me for information. Why are we reluctant to share the details of the investigation itself and comment on the case? Because I want to ensure a fair and impartial trial,” Gray said, nearing the presser’s conclusion. “I became a prosecutor because of my love for the ideals of this great country and the principles embedded in our Constitution.”

The state attorney emphasized that despite the prosecution’s mounting allegations, Robinson is “presumed innocent until we the state prove to an impartial jury of the defendant’s peers his guilt beyond a reasonable doubt.”

Robinson is scheduled for a brief hearing at 3 p.m. MT Tuesday to stand before a judge in the Utah Fourth District Court for his first appearance since his arrest, where he will be formally informed of the charges.

FBI director Kash Patel popped up on Fox News on Monday morning to discuss how he handled Wednesday’s assassination of Charlie Kirk. Naturally, his premature announcement that the conservative activist’s suspected shooter was in custody came up — but he doesn’t regret the tweet in question.

“So in the 24 hours after, when we were still looking for the guy, I know you posted that we got him and that ended up not being true,” “Fox & Friends” co-host Brian Kilmeade recapped. “You took some heat because of that. What led to you posting that, why did you feel so certain about it and what do you have to say about the criticism?”

“I appreciate this opportunity. Look, as I stated, I was being transparent with working with the public on our findings as I had them. I stated in that message that we had a subject and that we were going to interview him, and we did, and he was released,” Patel responded. “The job of the FBI is not just to manhunt the actual suspect who did the killing or suspects, but it’s also to eliminate targets and eliminate subjects who are not involved in the process. And that’s what we were doing.”

“Could I have worded it a little better in the heat of the moment? Sure. But do I regret putting it out? Absolutely not,” he further insisted. “I was telling the world what the FBI was doing as we were doing, and I’m continuing to do that. I challenge anyone out there to find a director that has been more transparent and more willing to work the media on high-profile cases or any case the FBI is handling than we have been.”

Kirk was shot on Wednesday while speaking at his American Comeback Tour stop at Utah Valley University in Orem, Utah. He was transported to a local hospital, where he later died from his injuries. He was 31.

While the investigation and manhunt were still developing day of, Patel (and Utah Gov. Spencer Cox) assured the public the suspected shooter was in custody.

“The subject for the horrific shooting today that took the life of Charlie Kirk is now in custody,” the FBI director wrote on X on Wednesday. “Thank you to the local and state authorities in Utah for your partnership with FBI. We will provide updates when able.”

In the end, two immediate persons of interest were both discovered not to be the suspected shooter. On Friday morning, President Donald Trump revealed on Fox News that 22-year-old Tyler Robinson had turned himself in for the shooting late Thursday night.

“He has heard concerns about how this looks,” an administration official told NBC News of Patel on Monday. “There are a lot of shaking heads.”
